10. Governing Law

These Terms are governed by the laws of the State of Texas. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Harris County, Texas.

11. Dispute Resolution and Arbitration

11.1 Informal Resolution

Before any formal proceeding, you agree to contact us at info@studioimagecreative.com and attempt informal resolution for at least thirty (30) days.

11.2 Binding Arbitration

Any dispute shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall be conducted in Harris County, Texas. The arbitrator's award shall be final and binding.

11.3 Class Action Waiver

YOU AND COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. This waiver applies to all disputes including claims under CIPA, ECPA, CCPA/CPRA, TDPSA, COPPA, or any other applicable privacy law.

11.4 Exceptions

The following are not subject to arbitration: (a) intellectual property claims; (b) injunctive relief; (c) small claims court actions.

12. Electronic Communications

By using the Site, you consent to receive electronic communications from us. Electronic communications satisfy any legal requirement that communication be in writing.

13. Severability and Entire Agreement

If any provision of these Terms is unenforceable, it shall be limited or eliminated to the minimum extent necessary. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us.
